With IPSTAR Broadband service, our goal is to ensure fair Internet access for all IPSTAR customers in order to give each one the fastest service possible at the lowest possible price. We maintain a Fair Access Policy (or "FAP") that helps make that possible.

We may assign a certain threshold to each service plan that limits the amount of data that may be downloaded and uploaded during a typical day upon our discretion. Customers who exceed the threshold will temporarily experience reduced speeds for both download and upload data. You will still be able to use the IPSTAR Internet access but your connection speed will be reduced.

IPSTAR may use traffic management equipment and prioritization tools to help ensure an equitable balance in Internet access for IPSTAR customers is guaranteed.

Based on an analysis of customer usage data, IPSTAR Japan may set a daily limit on data usage per customer, called a Data Limit. The Data Limit varies based on the service package you selected. This limit in each service package is well above the typical usage rates. Customers who exceed the threshold will experience reduced access speeds starting from the moment the Data Limit is met and lasting until midnight of that same day, after which the speed will resume back to that of the service package you selected. Depending on your service package and associated access speed, the access speed will be reduced to 25 percent of that of the service package you selected, i.e. if your service package is 512kbps/256kbps-upon reaching the Data Limit-your speed will be reduced to 128kbps/64kbps until midnight of that same day.

Please note that your Usage Total is far more likely to exceed the Usage Thresholds below if you use peer-to-peer file sharing programs such as Bit Torrent, Streaming (VDO and Audio), download full length movies, large quantities of music files, full software applications or similar high-bandwidth activities. These applications would affect not only the Usage Threshold but also the overall speed of your Internet connection.

• IPSTAR may revise this Fair Access Policy from time to time upon notice by posting a new version of this document on www.ipstar.jp, or any successor URL(s). All revised copies of the Policy are effective immediately upon posting.
